In the first part of the video, there’s a segment from AbemaPrime where a lawyer gives a legal opinion on online casinos. This lawyer was the legal advisor for the payment agency I was involved with. His opinion three years ago was that online casinos were not illegal in Japan. Of course, there have always been lawyers who believe they are illegal.
Furthermore, an official from the Yahatanishi Police Station (https://www.police.pref.fukuoka.jp/kitakyusyu/yahatanishi-ps/yanishitop26.html) stated that whether online casinos are illegal is case by case. They clarified that sites operated overseas are not illegal, but those operated domestically are, offering a clear legal interpretation.
I want to make it clear that my aim here is not to accuse the official of any wrongdoing. It’s important to state that the police at that time did not have a clear recognition that online casinos were illegal.
On a related note, one of the detectives who arrested me met me at my office two years ago. When I mentioned I was involved in payment processing, he did not see it as illegal. This was likely due to the same reasoning as the official in the video. However, during my interrogation, he pressured me, asking, “You knew it was illegal, didn’t you?” I wanted to ask him in return, “Did you think it was illegal all along? Or did you only recently come to understand that payment processing for online casinos is illegal, prompting you to ask this question?”
Suddenly declaring something illegal and arresting someone for it, then using that case to arrest others, is the police’s method of exerting state power.
They imprison a person (detaining them and prohibiting contact) to contest whether there is a legal issue, effectively using the person as a hostage. That’s how I feel my situation was handled.

3年前のオンラインカジノに対する警察の見解
まずはこの動画。
動画の前半でモザイクがかかっているアベマプライムの内容に登場している法見解を述べる弁護士は、僕が従事した収納代行の顧問弁護士である。オンラインカジノは日本では違法じゃないというのが3年前のこの弁護士の見解。もちろん、当時から違法だという判断をしている弁護士もいる。
そしてこの八幡西警察署（https://www.police.pref.fukuoka.jp/kitakyusyu/yahatanishi-ps/yanishitop26.html）の担当職員はオンラインカジノが違法かどうかはcase by caseだと述べている。海外で運営されているサイトは違法にならないが、国内で運営されている場合は違法だという一定の法的解釈の線引きを持った見解をしっかり述べている。
僕は彼の言質を取り彼に非があるのかを問いたいわけではないという事を改めてここで述べる。その上ではっきり言っておく。当時の警察は明確に違法だという認識がなかったのだ。
余談だが、僕を逮捕した刑事の一人は2年前に事務所であっている。決済代行をやっていると伝えてもそれが違法であるという認識は彼にはなかった。動画の職員と同じようなロジックを持っていたからだろう。しかし、取調べでは僕に対し、「違法と思ってやっていたんですよね？」と迫ってきた。僕も聞き返したかった。
「今まで違法と思っていたのですか？それともオンラインカジノに関わる決済代行が違法だとつい最近、あなたの頭にもインストールされたばかりだからこのような質問になってませんか？」
と。
急に違法だという見解を持ち出して、まず誰かを捕まえる。その捕まえた誰かの結果を応用してまた他の誰かを捕まえる。それが警察という国家権力のやり方である。
本当に法的に問題があるのかを争うために一人の人間を自由刑に処し（身柄を拘束して、接見禁止にする）、刑を確定させる。僕は自分の身を人質に取られたのだと思っている。
警察も、オンラインカジノ関係の予算が取れて、良かったね。
